1. Important Information
Prior to purchasing our products (MAGENTO THEMES), you'll be required to accept our Terms and Conditions. It is your responsibly to carefully read everything below.
2. Ownership
You do not claim intellectual property right or exclusive ownership to any of our products (MAGENTO THEMES), modified or unmodified. All products (MAGENTO THEMES) are property of Theme Exchange. Our products (MAGENTO THEMES) are provided "as is" without warranty of any kind, either expressed or implied.
3. Licenses
Theme Exchange offers Single License and Developer License in the time being. We hereby grant to you a perpetual, non-exclusive, non-transferable worldwide license(s) to use our products (MAGENTO THEMES).
4. Single License
This is our standard license, it's automatically included with each product (MAGENTO THEMES) you purchase. Please follow our permitted uses and restrictions carefully.
Permitted
1. SINGLE LICENSE IS FOR SINGLE USE ONLY.
2. YOU MAY CUSTOMIZE OUR PRODUCTS (MAGENTO THEMES) AS YOU PLEASE.
Restricted
1. YOU ARE NOT ALLOWED TO RESELL OR REDISTRIBUTE OUR PRODUCTS (MAGENTO THEMES) UNDER ANY CIRUMSTANCES.
2. YOU ARE NOT ALLOWED TO REMOVE OUR COPYRIGHT NOTICE FROM THE FOOTER.
3. YOU MAY NOT USE, EXTRACT, OR DISTRIBUTE GRAPHICS OR CODES OUTSIDE YOUR INSTALLATION.
5. Developer License
You may upgrade to our developer license if you're purchasing products (MAGENTO THEMES) for clients and/or need additional privileges. Please follow our permitted uses and restrictions carefully.
Permitted
1. DEVELOPER LICENSE ALLOWS YOU TO HAVE MULTIPLE INSTALLATIONS, PERFECT FOR DEVELOPERS USING OUR PRODUCTS (MAGENTO THEMES) FOR CLIENTS.
2. YOU MAY CUSTOMIZE OUR PRODUCTS (MAGENTO THEMES) AS YOU PLEASE.
3. YOU MAY REMOVE THE THEME EXCHANGE COPYRIGHT NOTICE ON THE BOTTOM.
Restricted
1. YOU ARE NOT ALLOWED TO RESELL OR REDISTRIBUTE OUR PRODUCTS (MAGENTO THEMES) UNDER ANY CIRUMSTANCES.
6. Exclusive License
Our exclusive license gives you full ownership of any theme you purchase it with; you may resell or redistribute it as you please. You are given full ownership of the theme. Upon purchase, the theme you choose will be removed from our website.
ONE EXCLUSIVE LICENSE GIVES YOU OWNERSHIP TO ONE MAGENTO THEME.
There's one exception however, a screenshot of the theme "Aesth" will remain on our homepage even after buying exclusive rights to it. You hereby must agree to this exception.
7. Services
Although our services are currently limited, here's a few things to know.
Theme Installation Service
If you purchase our theme installation service, please be advised that we will require FTP access. After your purchase, you will receive an e-mail from our support team requesting access to FTP.
8. Download
Due to hard drive failures and server crashes, it's easy to lose data. Theme Exchange allows you to download our Products (MAGENTO THEMES) up to 3 times from your 'My Downloadable Products' page in 'My Account.'
9. Refund
We do not offer any refund at this time. All sales are final until further notice. If your product is defected, although each product is heavily tested prior to it's sale, please contact us using the contact page.
10. Liability of Theme Exchange
YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL THEME EXCHANGE OR ANY OF ITS EMPLOYEES OR PARTNERS OR AFFILIATES BE LIABLE FOR ANY OBLIGATIONS HEREUNDER, INCLUDING BUT NOT LIMITED TO, ACTUAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING DAMAGES FOR LOSS OF PROFITS, INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) IN CONNECTION WITH ANY CLAIM, LOSS, DAMAGE, ACTION, SUIT OR OTHER PROCEEDING ARISING UNDER OR OUT OF THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY RIGHTS GRANTED TO YOU HEREUNDER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER THE ACTION IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OR OTHERWISE.
11. Terms and Conditions Changes
Our company reserves the right to change or modify the terms and conditions without prior notice.
